The driver accused in November of killing a 16-year-old Mesa girl on her way to meet her marching band for the Gilbert Days Parade had a blood-alcohol content of .19 – more than twice the legal limit, according to a Mesa police investigation.

Manuel Contreras-Galdean, 32, was arrested Nov. 15 and charged with manslaughter and aggravated assault in connection with the early morning collision that severely injured and later killed Kelly Tracy, 16, a sophomore at Gilbert’s Highland High School.

Contreras-Galdean has pleaded not guilty to the charges. Police have said Contreras-Galdean told them he has been living in the country illegally for several years, and he was placed on an immigration hold. He is being held at Maricopa County Jail without bond
According to the report, officers at the scene reported he smelled of alcohol and they saw “several beer cans” in Contreras-Galdean’s truck, a 1997 Dodge Ram.

Investigators have said that around 6:15 a.m. that day, Contreras-Galdean was headed eastbound on Guadalupe Road when he turned left on Sossaman Road in front of Matthew Tracy, 17, who was driving his sister in a 1994 Nissan Sentra west on Guadalupe Road. Contreras-Galdean struck the brother and sister nearly head-on, police said.

The brother and sister were on their way to meet with the Highland High School band that morning to perform in the Gilbert Days Parade. The crash occurred about a mile from the school.

Kelly suffered head and leg injuries and died later that morning at Maricopa County Medical Center as doctors were trying to save her life, police said.

Her brother, Matthew Tracy, a senior at Highland High, suffered facial abrasions, a hand injury and cracked ribs, police said.

Police said Galdean-Contreras was previously arrested at least twice on suspicion of drunken driving. He was stopped by Tempe police in 2007 and in 2001 by the Utah Highway Patrol in Salt Lake City. He was convicted in the Utah case.
